Trial Judge Refuses To Dismiss Charges Against Powerful Hollywood Mogul Harvey Weinstein

A New York judge, on Thursday morning, upheld the remaining criminal charges levelled against Hollywood movie producer, Harvey Weinstein, after he made a request through his attorneys that they should be dropped.

The decision by Justice James Burke of the state Supreme Court makes way for prosecutors to try Weinstein, who faces five counts, including rape.

The disgraced mega-producer who has been accused of numerous sex offences was charged with one count of first-degree rape, one count of third-degree rape, one count of criminal sexual act in the first degree. These charges are for two incidents — one in 2013 and another in 2004.

Weinstein’s legal team had accused alleged victims of lying and claims that the D.A.’s office and the police withheld evidence from the grand jury. Lead attorney Ben Brafman has argued that prosecutorial misconduct means the case should be disposed of.
But Judge Burke rejected the request and ruled that pre-trial hearings will take place on March 7. Burke’s decision was announced after attorneys from both the defence and prosecution huddled at the bench for roughly 10 minutes.
